Terms and Conditions of Sale

 
The sale of goods described on the customer?s receipt and bill of lading is made on the condition that the customer agrees to the terms below:

1.  All prices and inventory items subject to change without notice.

2.  All sales subject to pre-payment terms unless otherwise arranged.

3.  All items subject to prior sale.

4.  All sales in Texas subject to sales tax unless buyer provides valid resale certificate prior to shipment.  As of 07/18/2011, eDeck, Inc. does not sell or ship items to California or Florida.

5.  Freight charged as stated on invoice.

6.  Special orders cannot be returned.  Stock items may be returned only if request is made within 90 days of purchased and written authorization is received.  Buyer must ensure that returnable items or in orginal condition and is responsible for any freight charges for return.

7.  A 10% re-stocking charge fee applies to all returned merchandise.  Returned materials must be received by eDeck, Inc. in the same condition as they were when delivered to the freight carrier for original sale to the buyer.  No credit will be issued until the returned materials are received and inspected by eDeck, Inc.

8.  eDeck is not responisble for any shipping delays once order has been shipped. If a buyer cancels an order after transit has begun, he/she is responsible for all freight costs.  Freight costs are nonrefundable except in the case of total loss.

9.  It is the buyer's responsibility to coordinate delivery with the freight carrier, and must have the manpower available to off-load within given carrier's time alotment. Buyer is responisble for any subsequent over-time fees charged by carrier.

10.  Buyer will be assessed a restocking charge of 10% on refused shipments.

11.  All claims for shortages, damages, etc., must be made within 7 days of delivery date.  Claims must be made before installation and before working the original material.  On arrival of goods via freight, the buyer must note any damage or defect on the original bill of lading, and signed by a representative of the freight company. Any claims of damaged or defective material must be documented with photographic proof.  Claims may be submitted via email or telephone. Photos and the list of material claimed to be damaged or defective must be sent by email to sales@edeck.com. If damaged or defective material needs to be returned, it is the buyer?s sole responsibility for packaging and reloading of material for return.

12.  If item does not meet customer's requirements or specifications, buyer should contact seller immediately for correction or replacement.

13.  Substitution of materials is sometimes necessary based on availabity and quality of sizes.  We will do our best to fill your order as specified, but we also want to give you the highest quality; because wood is a material that has naturally-occurring variations, occasionally it is necessary to substitute items of a different length in order to give you quality material.

14. Services performed, including milling, pulling to specification, packaging and crating are non-refundable.  All sales of custom items are final.

15.  eDeck, Inc. reserves the right to change its terms without written notice.
